Littler on Legal Compliance Solutions for the Transformation of the Workplace Through Robotics, Artificial Intelligence, and Automation

Scope of Discussion. With the advance of new technologies (both hardware and software) that are able to perform tasks previously performed by humans, employers are constantly faced with new challenges. This publication provides an overview of the employment and labor law issues, solutions, and legislative and regulatory response to these new technologies. The publication’s approach is unique: rather than listing a dozen areas of employment and labor law and applying them generally to robotics, artificial intelligence, and automation, it divides these disruptive technologies into four categories: (1) robotics and automation; (2) wearable and performance-enhancing devices; (3) telepresence, telemanipulation and remote work; and (4) cognitive computing and then views each through the lens of the most applicable employment and labor challenges and solutions. Although specific technological innovations often cover more than one category, this approach provides employers with a means to more clearly understand and address the employment and labor law issues in light of these new technologies.
